What is Reasonable?
Just reading about the teacher that is facing up to 40 years for (possibly) looking at porn while at work. I say possibly because it is entirely reasonable as I understand things, to say that it could have been spyware.
The whole thing is nuts in my opinion. Child molesters get less time in prison than they’re threatening her with. And if the school’s IT department had kept the antispyware current and put in a good firewall this would have been next to impossible.
Yes, you can argue that she should have just turned the monitor off to get rid of the images. But I can see someone not too good with computers panicking and just not thinking to do it. And this was in 2004, so I don’t think antispyware was something as many people thought of. Heck, I know many people now who still don’t understand why they should have antispyware on their computer.
Addressing the possibility that she could have actually clicked on the sites, I’ll even grant that it’s possible. Not necessarily what happened, but think about those ads that are designed to make you click on them thinking you’re closing the window. If you aren’t tech saavy enough those can easily fool you. So yes, clicks could have happened, but I wouldn’t bet on their being deliberate.
I’ve dealt with the endless popup cycle in the past myself. It’s miserable to get out of, and people aren’t necessarily going to think to just turn the machine off to escape it.
Then there are the two jurors who were accused of talking about the case over lunch, witnessed by another juror, but denied by the two in question.
This is one of those cases where I just don’t see the justice. Fire her if you want, but to prosecute her is ridiculous.
